Overview and acceptance

This website is operated by NEAS under the Petmiva brand. In these Terms of Service, “Petmiva,” “we,” “us,” and “our” refer to NEAS. These Terms govern your access to and use of petmiva.com, our online store, and the related content, products, features, and services collectively referred to as the “Services.”

By accessing the Services or placing an order, you agree to these Terms and to the policies linked or incorporated into them, including our Privacy Policy, Return and Refund Policy, and Shipping Policy. If you do not agree, do not use the Services.

Our store is hosted by Shopify, which provides the ecommerce platform used to offer the Services.

Eligibility and accounts

You must be at least the age of majority where you live, or use the Services with the involvement and permission of a parent or legal guardian. You are responsible for the accuracy of information supplied through your account and for keeping account credentials secure. Notify us promptly if you suspect unauthorized activity.

Products and pet safety

We work to describe and display products accurately, but colors, dimensions, packaging, and appearance may vary slightly because of screens, manufacturing updates, or supplier changes. Product availability and quantities are not guaranteed.

Select products and sizes appropriate for your pet. Read and follow all product instructions and safety warnings. Supervise pets when using toys, apparel, feeding accessories, grooming items, and other products when appropriate. Remove any product that becomes damaged or presents a potential hazard. Content on the Services is general information and is not veterinary or medical advice. Consult a qualified veterinarian regarding your pet's health or safety.

Prices and availability

Prices, promotions, descriptions, and availability may change without notice. Prices do not include taxes, shipping, customs duties, or other charges unless expressly stated. We may correct errors and cancel or adjust an affected order, including after submission, subject to applicable law. If payment has been captured for a canceled item, we will issue an appropriate refund.

Orders and payment

An order confirmation acknowledges receipt of your order but does not guarantee acceptance. We may decline, limit, or cancel an order for reasons such as suspected fraud, payment failure, inventory issues, pricing errors, shipping restrictions, or apparent unauthorized resale. You agree to provide current, complete, and accurate billing, payment, contact, and shipping information.

Payments are processed by third-party payment providers. Petmiva does not directly store complete payment-card details. Your use of a payment method is also subject to the provider's terms.

Shipping, returns, and refunds

Shipping and delivery are governed by our Shipping Policy. Returns, exchanges, cancellations, and refunds are governed by our Return and Refund Policy. Those policies form part of these Terms.

Acceptable use

You may not use the Services to break the law; infringe intellectual-property, privacy, or other rights; submit false or misleading information; distribute malicious code; attempt unauthorized access; interfere with security or operation; scrape or harvest data without permission; send spam; impersonate another person; or engage in fraudulent, abusive, threatening, discriminatory, or harmful conduct.

We may restrict or terminate access when we reasonably believe these Terms have been violated.

Reviews, feedback, and other submissions

If you submit a review, photograph, suggestion, or other content, you represent that you have the right to provide it and that it is truthful and does not violate the rights of others. You grant Petmiva a non-exclusive, worldwide, royalty-free license to host, reproduce, edit for formatting or clarity, publish, translate, and display that content in connection with our business and marketing, subject to applicable law.

We may moderate or remove content that is unlawful, deceptive, offensive, irrelevant, or otherwise violates these Terms. We are not obligated to keep submissions confidential or compensate you for unsolicited feedback.

Intellectual property

The Services, including Petmiva branding, text, graphics, photographs, layouts, and other content owned by or licensed to us, are protected by applicable intellectual-property laws. Except as allowed by law, you may not copy, reproduce, distribute, modify, publish, sell, or exploit our content without prior written permission.

Third-party services and links

The Services may contain links to or integrations with services operated by third parties. We do not control and are not responsible for third-party content, security, availability, policies, or practices. Review the applicable third-party terms before using those services.

Privacy

Our collection and use of personal information are governed by our Privacy Policy. Shopify and other service providers may process information as described in that policy and their own privacy notices.

Disclaimers

To the maximum extent permitted by law, the Services are provided on an “as available” basis. We do not promise that access will always be uninterrupted, secure, or error-free. Any warranties or conditions that cannot lawfully be excluded remain in effect.

Limitation of liability

To the maximum extent permitted by law, NEAS, Petmiva, and their personnel and service providers will not be liable for indirect, incidental, special, punitive, or consequential loss arising from the Services or products, including loss of profits, revenue, data, or business opportunity. This limitation does not apply where liability cannot lawfully be limited or excluded, including rights available under applicable consumer law.

Indemnification

To the extent permitted by law, you agree to reimburse and protect NEAS and Petmiva from third-party claims, losses, and reasonable costs arising from your unlawful use of the Services, your material violation of these Terms, or your infringement of another person's rights.

Governing law

These Terms are governed by the laws of the Commonwealth of Virginia and applicable federal laws of the United States, without regard to conflict-of-law principles. Mandatory consumer protections available where you live are not excluded by this section.

Severability and waiver

If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.

Changes to the Services or these Terms

We may update the Services and these Terms from time to time. The revised Terms will be posted on this page with a new effective date. Your continued use of the Services after an update constitutes acceptance where permitted by law.

Entire agreement

These Terms and the policies incorporated into them constitute the agreement between you and NEAS concerning the Services and replace prior communications about the same subject, except for terms that apply to a specific written promotion, product, or service.
